With a blood alcohol concentration (BAC) of 0.08% or higher, a driver at least 21 years old may be convicted of driving under the influence (DUI). Even with a BAC of at least 0.05% but less than 0.08%, the driver may be convicted of driving while impaired (DWI) if there is other evidence that he or she was driving under the influence of alcohol.
